Delivery & Access: Digital files download automatically after successful payment and appear on the order confirmation page, with a download link also sent by email.
1) Acceptance of Terms
By accessing or purchasing from our website (the “Site”), you agree to these Terms of Service (the “Terms”) and our other posted policies (including the Return & Refund Policy and Privacy Policy). If you do not agree, do not use the Site. These Terms constitute a legally binding agreement between you and Mishka Media Ltd (“Mishka Media,” “we,” “us,” or “our”).
2) Who May Use the Service
You must be at least 16 years old to purchase. Our products are offered only to residents of the United States. If you access the Site from outside the U.S., you do so at your own initiative and may not purchase.
3) Digital Products & License
All offerings are digital content (e.g., e‑books, checklists, templates). Purchases grant you a personal, limited, non‑exclusive, non‑transferable, non‑sublicensable license to download and use the files for your own non‑commercial purposes. You may not share, post, resell, distribute, or make derivative works from our content without our written permission.
4) Orders, Pricing, Taxes, and Payment
You authorize us (and our payment processors) to charge your selected payment method for the total price shown at checkout, including any applicable taxes. We may cancel or refuse any order (for example, suspected fraud). Prices are subject to change without notice until an order is placed.
5) Delivery & Access (Digital Only)
Upon successful payment, your download begins automatically on the order confirmation page. A “Download now” link also appears there and is sent by email. Delivery is complete when the download starts or the link is presented. Keep your email and order number for your records.
6) All Sales Final — No Returns or Refunds
Because our products are digital and accessible immediately, all sales are final and non‑refundable except where required by law. For details, see our Return & Refund Policy.
7) Electronic Communications & Signatures
You consent to receive receipts, disclosures, and other communications electronically, and agree that clicking “I agree,” checking a box, or completing a purchase constitutes your electronic signature. You may withdraw consent by contacting us, but doing so may limit our ability to provide the services.
8) User Content (Reviews, Comments)
If you submit reviews or comments, you grant Mishka Media a perpetual, worldwide, royalty‑free license to use, reproduce, and display that content for promotional and operational purposes. Do not submit anything unlawful, infringing, or misleading. We may remove content at our discretion.
9) Intellectual Property & DMCA Notice
All content on the Site is owned by or licensed to Mishka Media and protected by intellectual property laws. If you believe material on the Site infringes your copyright, send a DMCA notice including: (a) your signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its URL; (d) your contact information; (e) a statement of good‑faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner. 10) Prohibited Uses
You agree not to: (a) share or resell downloads; (b) bypass access controls; (c) scrape or reverse‑engineer the Site; (d) upload malicious code; (e) violate laws or third‑party rights; or (f) use the Site to harass, defraud, or mislead others.

12) Disclaimers

13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISHKA MEDIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

These Terms are governed by the laws of the United States and, to the extent not preempted, the laws of the state where Mishka Media’s principal place of business is located, without regard to conflict‑of‑laws rules. Any dispute shall be brought in the state or federal courts located in that state and county; you consent to their jurisdiction and venue.
16) Changes to the Terms
We may update these Terms from time to time. Changes are effective when posted with a new “Effective date.” If changes are material, we will provide reasonable notice (e.g., by banner or email).
